Terms of Use

These terms are the agreement between you and Oleksii Kravchenko about the Oculo mobile app (“Oculo”, “the app”) and the pages on https://oculo.day. They also serve as the end user licence agreement (EULA) required by the app stores. Please read section 4 even if you read nothing else.

1. Who you are agreeing with
Oculo is published by Oleksii Kravchenko, Carrer de Les Barraques del Figuero (“we”, “us”). “You” means the person using the app.
Your agreement for the app itself is with us. Your agreement for the purchase is with Apple or Google, whichever store you bought through - see section 8.
2. Accepting these terms, and changes to them
By downloading, opening or using Oculo, you accept these terms. If you do not accept them, do not use the app.
We may change these terms - for example when a feature changes or the law does. The current version is always at https://oculo.day/terms with its effective date. If a change is material and disadvantages you, we will make it visible in the app before it takes effect. Continuing to use Oculo after a change takes effect means you accept the new version. If you do not accept it, stop using the app and cancel any subscription as described in section 8.
3. Who may use Oculo
Oculo is intended for adults. You must be at least 16 years old, or the minimum age of digital consent in your country if that is higher. It is not a children’s app, it is not intended for use by children, and it contains no content designed for them. The app does not verify your age; by using it you confirm that you meet this requirement.
4. Health, safety and what Oculo is not
Oculo is a wellness and habit app. It is not a medical device, and nothing in it is medical advice. This is not a formality; it is the core of what you are agreeing to.
Specifically:
- Oculo does not diagnose, treat, cure or prevent any disease or condition, and we make no claim that it does.
- Oculo does not change your refraction. It will not improve your visual acuity, reduce your prescription or remove your need for glasses or contact lenses. Eye muscle exercises do not change your refraction, and we would rather say that plainly than sell you something else.
- Oculo is not a substitute for an eye examination, an optometrist, an ophthalmologist or any other healthcare professional.
- What Oculo does is give your eyes short, structured breaks from the screen, guided eye movements and relaxation practices, and a habit that is easy to keep.
Consult a professional before you start if you have a diagnosed eye condition, have had eye surgery or an eye injury, suffer from migraines, have epilepsy or any photosensitive condition, are pregnant, or are in any doubt. If you are under the care of an eye care professional, follow their instructions, not ours.
Some exercises use moving shapes and brief flashes of light. If you are sensitive to flashing or flickering light, or have ever had a seizure triggered by it, do not use the app without medical advice first.
Stop immediately and consult a professional if you experience pain, a headache, dizziness, nausea, double vision, blurring that does not pass, flashes, floaters or any change in your vision. Discomfort is a reason to stop, not to push through.
Some situations are emergencies, not reasons to “consult”. A sudden shower of flashes or floaters, a curtain or shadow across your field of view, or a sudden loss of vision require urgent medical care. Do not wait, and do not finish the session first.
Never press on your eyes. The exercise that covers the eyes is done with the palms resting on the cheekbones and the forehead, with no pressure on the eyeball. Do your sessions sitting down, and stop if you feel unsteady.
Do not use Oculo while driving, cycling, walking in traffic, operating machinery, or in any other situation where closing your eyes or following a moving target could hurt you or someone else.
You use Oculo voluntarily and you are responsible for deciding whether it is appropriate for you.
5. Your licence
We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use one copy of Oculo on devices you own or control, for your own non-commercial use, in line with the rules of the store you downloaded it from.
You may not:
- copy, sell, rent, sublicense, lease or redistribute the app or any part of it;
- reverse engineer, decompile or disassemble the app, except to the extent that applicable law expressly allows it and we cannot contractually exclude that right;
- remove or alter any copyright, trademark or other proprietary notice;
- use the app’s content (exercise descriptions, animations, instructions, text, audio, artwork) in another product, service or dataset, including to train a machine learning model;
- circumvent, disable or interfere with the purchase flow, the entitlement check or any security measure, or use the paid features without paying for them;
- use the app in any way that breaks the law.
6. No account, and what that means for your data
Oculo has no accounts and no cloud sync. Your practice history, your streak and your settings live on your device. This has a consequence you should understand: if you lose your device, reset it, or delete the app, that data may be gone.
The app relies on the backup mechanism your platform provides (Android Auto Backup or the iCloud Key-Value Store) so that your progress can follow you to a new phone. Those backups belong to your Google or Apple account and are governed by their terms. We do not operate them, cannot restore them for you and do not guarantee that a restore will succeed.

7. Free features and Oculo Pro
Oculo is free to download and includes, at no cost: a set of free exercises, the daily plan, the quick session for tired eyes, reminders and the streak. There are no advertisements.
Oculo Pro is a paid subscription that unlocks the full exercise library and the adaptive daily plan. The exact composition of free and Pro content may change over time as exercises are added, improved or retired (section 9). We will not move a feature out of the free tier in a way that makes the free app unusable, but we do not promise that today’s split is permanent.
8. Subscriptions, trials, billing and cancellation
Who sells it. Oculo Pro is sold as an auto-renewable in-app subscription by Apple (App Store) or Google (Google Play). The payment contract is with them. We never receive or store your payment details.
What you see before you pay. Before you confirm a purchase, the app and the store show you the subscription name, its length, the price, the length of any free trial, and the date of the first charge. If anything is unclear at that moment, do not confirm.
Free trial. Where a free trial is offered, it is typically 7 days. Trial eligibility is determined by the store, usually once per Apple ID or Google account per product family. Unless you cancel at least 24 hours before the trial ends, it converts into a paid subscription and the store charges you the price shown.
Auto-renewal. The subscription renews automatically at the end of each period at the then-current price, unless you cancel at least 24 hours before the period ends. The store charges your payment method within 24 hours before the period ends.
How to cancel. In the store, not in the app, and not by writing to us - we cannot cancel it for you:
- iOS: Settings → your name → Subscriptions → Oculo → Cancel Subscription.
- Android: Google Play → Payments and subscriptions → Subscriptions → Oculo → Cancel.
Deleting the app does not cancel your subscription. Cancelling stops future renewals; you keep access until the end of the period you already paid for.
Refunds are decided by Apple or Google under their own policies, through https://reportaproblem.apple.com or https://play.google.com/store/account. Statutory consumer withdrawal rights, where they apply, are unaffected by this paragraph. We have no technical ability to issue a refund for a store purchase, and may decline requests sent to us for that reason alone.
Price changes. If we change prices, the new price applies to future renewal periods only, and the stores notify you and ask for your consent where their rules require it. You can always cancel before the next renewal.
Restore Purchases. If you reinstall the app or move to a new device using the same store account, use “Restore purchases” on the paywall or in Settings to get your access back. Access cannot be transferred between an Apple ID and a Google account - they are separate purchases in separate stores.
Family Sharing / family library. Where a store feature of this kind is enabled for a product, the store’s rules for it apply.
9. Changes to the app
We may add, change, suspend or remove features, exercises and content, and we may stop supporting older operating system versions. If we discontinue the app or a paid feature entirely, we will give reasonable notice in the app and stop charging for anything we no longer provide.
10. Intellectual property
Oculo, its name, its logo, its design, its code, its exercise programmes, its animations, its texts and its audio belong to us or to our licensors, and are protected by copyright and trademark law. These terms grant you a licence to use the app, and nothing else. Open source components are used under their own licences, including the Archivo typeface under the SIL Open Font License.
Apple, the Apple logo and App Store are trademarks of Apple Inc. Google Play and the Google Play logo are trademarks of Google LLC. We are not affiliated with, endorsed by or sponsored by either.
11. Feedback
If you send us an idea, a bug report or a suggestion, thank you - and we may use it to improve the app without owing you payment, credit or confidentiality. You keep whatever rights you have in it; you simply grant us permission to act on it. Do not send us anything you consider confidential or that you are not free to share.
12. Acceptable use
Use the app as it is meant to be used. Do not attempt to break it, overload the services it depends on, probe them for vulnerabilities, impersonate anyone, or use the app to harm others. If you find a security problem, tell us at support@oculo.day before telling anyone else, and give us a reasonable chance to fix it.
13. Third-party services
Oculo depends on services operated by others: the App Store and Google Play for distribution and payment, RevenueCat for subscription entitlements, Firebase for crash reports and anonymous usage statistics if you opt in, and your operating system’s notification and speech engines. Their terms and privacy policies govern their part. We are not responsible for their availability, and an outage at one of them may make purchases or restores temporarily impossible. Everything else in the app keeps working offline.
14. Disclaimer of warranties
To the fullest extent permitted by law, Oculo is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the app will be uninterrupted or error-free, that any defect will be corrected, or that it will produce any particular result for you.
Nothing in these terms excludes or limits any statutory warranty or consumer right that cannot be excluded or limited under the law that applies to you. If you are a consumer in the European Union, the United Kingdom or another jurisdiction with mandatory consumer protection, those rights apply in full, whatever this section says.
15. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or lost opportunity, arising out of or related to your use of Oculo.
Our total liability for all claims relating to the app is limited to the greater of (a) the amount you paid us, or paid to a store for Oculo, in the 12 months before the event giving rise to the claim, or (b) €50.
Nothing in this section limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited by law.
16. Indemnity
You agree to indemnify us against claims, damages and reasonable costs arising from your breach of these terms or your unlawful use of the app. This does not apply to the extent the claim results from our own act or omission, and it does not apply where mandatory consumer law prevents it.
17. Termination
You may stop using Oculo at any time by deleting it, and cancel any subscription as described in section 8. We may suspend or terminate your licence if you materially breach these terms - proportionately, and with notice where it is reasonable to give it. Sections 4, 10 and 14 to 18 survive termination.
18. Governing law and disputes
These terms are governed by the laws of Spain, without regard to conflict-of-laws rules.
If you are a consumer resident in the European Union, the United Kingdom or Switzerland, this choice of law does not deprive you of the protection of the mandatory consumer law of your country of residence, and you may bring proceedings in the courts of that country. Otherwise, the courts of Spain have exclusive jurisdiction.
Before going to court, please write to support@oculo.day. Most problems turn out to be a bug.
19. Additional terms for the Apple App Store
These terms apply if you obtained Oculo from the Apple App Store. They are required by Apple, and where they conflict with the rest of this agreement, they prevail for the App Store version.
- This agreement is between you and us only, not with Apple. Apple is not a party to it and is not responsible for Oculo or its content.
- Scope of licence. Your licence is non-transferable and limited to using Oculo on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms of Service.
- Maintenance and support. We are solely responsible for providing maintenance and support for Oculo, at support@oculo.day. Apple has no obligation to furnish any maintenance or support.
- Warranty. To the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to Oculo. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, of the app. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Oculo.
- Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to Oculo or your use of it, including product liability claims, any claim that Oculo fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
- Intellectual property claims. If a third party claims that Oculo infringes its intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer contact. Questions, complaints and claims about Oculo should be directed to Oleksii Kravchenko, Carrer de Les Barraques del Figuero, support@oculo.day.
- Third-party terms. You must comply with applicable third-party terms of agreement when using Oculo.
- Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of this section, and have the right to enforce it against you.
20. Additional terms for Google Play
If you obtained Oculo from Google Play, the Google Play Terms of Service also apply to your download and purchase. Google is not a party to this agreement and is not responsible for Oculo. Subscription management and refunds are handled by Google as described in section 8.
21. General
These terms, together with the Privacy Policy, are the entire agreement between us about Oculo. If any provision is held unenforceable, the rest stays in force and the unenforceable part is applied to the maximum extent permitted. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a transfer of the app, provided your rights are not reduced. These terms are written in English; a translation is provided for convenience only, and the English version prevails in case of conflict.
